SGRV Members Brooke C. Madonna and David Picker Secure Summary Judgment in Favor of Their Clients

Spector Gadon Rosen Vinci P.C. Members Brooke C. Madonna and David B. Picker have successfully secured affirmance of the Summary Judgment entered in favor of their clients, Andrea Desy Edrei, Michael Skokowski and Kailey Bondiskey, in the Philadelphia Common Pleas case of TCS Black Label Realty, LLC and The Condo Shop, LLC v. Ryan Serhant, Serhant Pennsylvania, LLC, Andrea Desy Edrei, Michael Skokowski, Jr. and Kailey Bondiskey. 2026 WL 251144, 2026 PA Super 17 (Pa.Super., Jan. 30, 2026).

Appellants appealed from the summary judgment entered against them on all counts by Judge Patrick on November 5, 2024. After hearing argument on August 13, 2025, the Pennsylvania Superior Court, on January 30, 2026, affirmed summary judgment on all seven claims, holding Appellants failed to produce fact-grounded proof of damages and relied on a speculative expert report that assumed destruction of Black Label’s profits, despite contrary testimony by Plaintiffs’ principals that Black Label remained in business. The court also affirmed rejection of Plaintiffs’ misappropriation, tortious interference, conversion, breach of fiduciary duty, and breach of contract claims, finding insufficient evidence of a breach and/or insufficient evidence linking any breach to any actual damages.
