Spector Gadon Rosen Vinci P.C. Attorney Brooke C. Madonna secured a favorable ruling for her clients, winning an injunction hearing in the ongoing case The CondoShop LLC and TCS Black Label Realty LLC v. Ryan Serhant, Serhant Pennsylvania LLC, Andrea Desy Edrei, Michael Skokowski and Kailey Bondiskey. Ms. Maddona represented Defendants Edrei, Skokowski and Bondiskey.

In March of 2023, Edrei ceased to be an agent with TCS Black Label Realty LLC, although she remained an owner in Black Label. As the TCS Black Label Realty LLC Operating Agreement expressly permitted, Edrei was entitled to open a competing venture. She opened Societe Select LLC, and in April 2023 she and her team consisting of Skowkowski, Bondiskey, and former Black Label agents, who too were dissatisfied with Black Label, followed Edrei to work with Serhant. In April 2023, the Plaintiffs filed a Complaint seeking $10 million along with an Emergency Motion for Injunctive Relief against the Defendants, claiming that Ryan Serhant, along with Andrea Desy Edrei, entered into a scheme to “plunder its clients, intellectual property, confidential information, and personnel while crippling its ability to operate.”  The Plaintiffs sought limited discovery, including depositions of the parties.

The Plaintiffs were seeking, inter alia, the return of their alleged confidential and proprietary documents including client lists and marketing material and to enforce noncompetition agreements against Skokowski and Bondiskey. On February 21, 2023, a hearing seeking injunctive relief was argued before the Honorable Paula A. Patrick. The Court denied the Plaintiffs’ Motion after argument of counsel without requiring any additional witness testimony.
