John T. Asher, III

Member

John T. Asher, III is a Member of the firm’s Insurance Coverage & Casualty Litigation Group where he handles a wide range of litigation matters involving premises liability, auto liability, real estate litigation, landlord-tenant litigation and commercial litigation. Mr. Asher handles litigation matters from inception through trial, as well as any appeals which may arise.

Mr. Asher has had a number of favorable trial results.  One notable result was a jury verdict for $277,000 in the Court of Common Pleas of Philadelphia in the matter of Mikalic v. Palmer, et al., where Mr. Asher successfully brought a claim for wrongful use of civil proceedings under 42 Pa.C.S.A. 8351 which arose from a claim against his client under the Abandoned and Blighted Property Conservatorship Act, 68 P.S. § 1101, et seq.

Mr. Asher also received a favorable decision in a quiet title action where he represented a defendant in a claim that his property was encroaching upon the property of an adjacent property owner. In that action, Mr. Asher counterclaimed for quiet title arguing that the alleged encroachment was in existence for a sufficient period of time that his client acquired ownership of the alleged encroachment under the doctrine of consentable lines, which was successful.

Mr. Asher has several appellate decisions, including Kaur v. Garden State Fuels, Inc., et al., N.J. Super., App. Div., No. A-2315-17T1; Tameru v. W-Franklin, LP, 2009 U.S. App. Lexis 23724 (3d Cir. 2009); Aquilino v. The Philadelphia Catholic Archdiocese, 2005 Pa. Super 339, 884 A.2d 1269 (2005), and Franchi v. Tschop, 883 A.2d 698 (Pa. Super. 2005).

Mr. Asher is a member of the American Bar Association, the National Restaurant & Retail Defense Association, the Claims & Litigation Management Alliance, and Citizens Diplomacy International, formerly International Visitors Council.

Mr. Asher is admitted to the bars of Pennsylvania, New Jersey and Florida. He is also admitted to practice before the United States District Court for the Eastern and Middle Districts of Pennsylvania, the United States District Court for the District of New Jersey, the United States District Court for the Southern District of Florida, and the United States Court of Appeals for the Third Circuit.
